We (Screenplay Gurus) do not hold any claim to your work.
Your submission of materials permits us to read and critique your work, but in no way gives us any claim of ownership or rights to any of your ideas, characters, plot, themes, or any other script elements. Nor will we or any of our employees or assigns distribute, in any way, your information or your work to any third parties.
There may be disagreement with our critique of your work.
Writers who are in any way averse to receiving critical feedback they might disagree with are respectfully requested to not use our service. Screenplay Gurus provides critical feedback.
There are no refunds or remediation of any kind for the following:
1. You disagree with the reader(s) opinions or critique in any way.
2. You disagree with the focus of our reader(s) on certain script elements whether they are or are not elements on which you would rather they not focus. Purchasing our service does not entitle you to dictate the critical focus of our reader(s).
3. You assert the reader(s) made inaccurate comments. If an element is not clear in your script, or if our reader missed some element(s), it’s likely a reader at an agency, studio, or contest will also miss the element or note a lack of clarity.
4. Should our reader(s) be out of alignment with a previous reader’s notes either from the same order, a previous service we provided, or from another company, understand our reader(s) do not read other reader’s coverage.
5. We do not offer Rush Service. Missing a deadline of any kind due to our services not arriving in time to meet the deadline does not invalidate the notes.
Your opinion on the objective clarity of any element in the submitted work is not taken into account.
Every word of every line of every page is read by our readers. That does not assure the reader(s) find clarity in any or all script elements. An assertion your script is one hundred percent clear may not be transferable to someone reading your script for the first time.
We reserve the right to critique, or not, any aspect of your work.
Our readers are free to write at length or as little about each aspect of your script as they see fit. Aspects or details of your script may be commented upon less, or even ignored, at the expense of a focus on others. We do not provide refunds because you believe our reader(s) didn’t focus in a direction you choose.
There are variances in scores, recommendations, and critiques.
Any score, recommendation, or critique in variance from another does not in way invalidate our service or the provided value, and does not entitle you to a refund or remediation.
Turnaround time varies, and is not guaranteed.
Turnaround times are an estimate. Not providing a service within the estimate time doesn’t invalidate our service, and does not entitle you to a refund or any other remediation.
Our turnaround is between five and ten days.
Your Paypal or credit card statement reads SCREENPLAYG or PAYPAL SCREENPLAYG or similar.
If you dispute a charge on your statement because you do not recognize it, you agree to pay any charge backs plus any fees we incur due to your failure to recognize the charge on your statement when it appears.
We do not swap scripts once you’ve submitted.
It’s too confusing and too much work for your reader(s). And they don’t get paid for starting over.
Our Follow-Up Question procedures.
Follow-up questions must be sent in within 14 days of delivery of coverage, and are limited to three questions. If you pose more than three questions, or request a reader conference, we will email you for approval of an additional $25 fee.
Not to contact our personnel outside of Screenplay Gurus.
We guard the anonymity of our readers for very good reason. Sadly, they’ve been harassed. We have assured our readers their safety is our greatest concern. If you try to contact our readers, you will be permanently banned from using our service.
Payment processing fees are not refundable.
Any merchant gateway, or other processing charge or fee, are not refundable under any circumstances.
Acceptance of these terms is legally binding.
By accepting these terms, you are joining into a binding, legal contract that is valid and enforceable within a court of law.
Limitation of Liability
You expressly understand and agree that Screenplay Gurus and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (regardless of whether Screenplay Gurus has been advised of the possibility of such damages), resulting from:(i) The use or the inability to use the Screenplay Gurus service;(ii) The cost of the procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages receives or transactions entered into through or from the Screenplay Gurus service; or(iii) Any other matter(s) relating to the Screenplay Gurus service.
Miscellaneous Terms
The terms of the User Agreement constitutes the entire agreement between you and Screenplay Gurus and governs your use of the Screenplay Gurus service.
Furthermore, the terms of this Agreement and the relationship between you and Screenplay Gurus shall be governed by the laws of the State of New York without regard to its conflict of law provisions. You and Screenplay Gurus agree to submit to the personal and exclusive jurisdiction of the courts located within the New York county of Oneida.
The failure of Screenplay Gurus to exercise or enforce any right or provision of the Agreement shall not constitute a waiver of such right or provision. If any provision of the Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Agreement remain in full force and effect. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Screenplay Gurus service or the Agreement must be filed within 3 months after such claim or cause of action arose or you will be barred from raising such a claim(s).
